Store Policies

By using this website, the La Piastra mobile application (the “Mobile Application”), or any of our Services (collectively, the “Services”), you are agreeing to abide by these Policies of Service (the “Policies”), which constitute a legally binding agreement between you and La Piastra, LLC (“La Piastra,” “we,” or “us”) and which govern your use of the Services. The Policies may be updated by us from time to time without notice to you.  If you do not agree to any of these Policies, please do not use the Services.

Time Frame. La Piastra is a production facility that manufactures freshly prepared, fully cooked meals packaged in oven safe containers (the “Products”). Production commences at 6:00 am and orders can be fulfilled by approximately 12:00 pm daily. All orders must be fully paid in advance to guarantee availability.  Orders must be placed at least 1 hour in advance of your pick up time. Restocking fees will apply for cancellations after the order is pulled from the retail merchandisers, or if your order is not picked up during your selected time frame unless you call us prior to close of business on the day the order is due.

Same Day Pickup: Orders for same day pickup must be placed by 4:30 pm. Once you place your order, you will receive an e-mail confirmation. Please call 860-632-7528 if you do not receive the e-mail confirmation.

Order Selection and Storage. By placing an order through the Mobile Application or online ordering service, you have authorized a La Piastra agent to select from available inventory to fulfill your order.  Your order will be selected and reserved in our walk-in cooler to ensure product quality. For optimum freshness, please properly store your order within 30 minutes after pickup. We cannot guarantee or be held liable for the quality of items that are not properly stored after pickup.

To maintain the quality and integrity of the Products, we recommend that you immediately refrigerate all perishable Products upon delivery and follow the U.S. Department of Agriculture’s (“USDA”) instructions on refrigeration and food safety, which can be found here. We recommend that you follow the USDA’s instructions on safe food handling, which can be found here. We also recommend that all cooking instructions be followed and that you use a food thermometer to ensure that all meat, poultry, seafood and other applicable items are cooked to the USDA’s recommended internal temperatures, which can be found here. Failure to follow safe food handling practices and temperature recommendations may increase the risk of foodborne illness. In addition, pregnant women, young children, the elderly and individuals with compromised immune systems should follow the U.S. Food and Drug Administration’s recommendations on food consumption for at-risk groups, which can be found here.

Expiration Dates. Expiration dates on products are clearly printed on the Products. All Products carry a four day shelf life from the package date.  Some Products may be frozen beyond the expiration date.  See label for recommended instructions.  We do not recommend freezing items with pasta, vegetables or fish.  Customers are responsible for checking all expiration dates of all in-store purchases prior to purchase. Items will not be accepted for return or be replaced based on the customer’s desired time frame to enjoy the products.

Outside Vendors. La Piastra carries a variety of Gluten Free and other products from outside vendors available for purchase.  LA PIASTRA, NOT BEING THE MANUFACTURER OF OUTSIDE VENDOR PRODUCTS, NOR THE AGENT OF SUCH MANUFACTURERS, MAKES NO EXPRESS OR IMPLIED WARRANTY OF ANY KIND WHATSOEVER WITH RESPECT TO OUTSIDE VENDOR PRODUCTS AND DISCLAIMS ANY SUCH WARRANTIES THAT MIGHT OTHERWISE EXIST.

Loyalty Points.  If you are a member of La Piastra’s Loyalty Rewards Program, please enter in your Rewards Phone number while placing an online order.  The Rewards Phone number refers to the phone number you signed up with when you joined the program.  If you are unaware of your Rewards Phone Number, please call the store at 860-757-3052 and ask a Sales representative to look up the phone number affiliated with your accrued points.

If you are NOT a member of the Loyalty Rewards Program, a new profile will be created in our Point of Sale (POS) System automatically upon registration.

Points Accrual and Rewards Redemption.  Rewards Members receive a point for every dollar spent in our retail Gourmet to Go location(s). Once a Reward’s Member achieves a 150 point balance, they will receive $5 off a purchase of $20 or more. The Point of Sale will recognize the eligible order based off of the sub-total (pre-tax). Points do not accrue for catering or special orders. Points do not expire.  Only (1) one $5 program discount may be applied at a time.  Members may not redeem more than $5 in program rewards per visit.

Redemptions for the Loyalty Program can be applied to online orders. Redemptions may be applied to the balance of a catering or special order. If you would like to check your Rewards balance, please contact us at 860-757-3052.

If you have forgotten to enter your rewards card during your in-store visit, or have inadvertently signed up for a second Rewards Card online through the web site or online application, please present your receipt to a Manager within 7 days of purchase for an adjustment to your points balance. Without the receipt for purchased items, La Piastra will not be able to determine adjust your points balance.

La Piastra reserves the right to change, modify, eliminate, terminate, discontinue and/or cancel the Loyalty Rewards Program, associated rewards and/or all or any portion of these Policies or any policy, or guideline pertaining to the La Piastra Loyalty Rewards Program at any time and in its sole discretion without notice to you.

Coupon Eligibility and Redemption. If you are a subscriber to our monthly e-newsletter, you will receive a unique coupon code that may be redeemed for instore or online purchases.  Coupons are only valid for and may be only used once during a given month.  Customers who purchase an entrée and one other item with valid coupon code will receive $3 off purchase. If you do not have a smart phone, you may print or write down the unique code you received from the e-newsletter.

Coupons can be redeemed towards online purchases. Enter coupon code in discount code field at check out.

Combined Offers.  Members of our Loyalty Rewards Program and subscribers to our e-newsletter who receive a coupon and are simultaneously eligible for a Rewards Redemption will need to determine which offer they would like to receive at the time of purchase.  Combined offers will not be accepted in the same purchase.

Store Credit. If you are not satisfied for any reason with an item purchased through the La Piastra online ordering system, please contact us at 860-757-3052 within 4 days of pick-up and let us know about your concern. Depending on the circumstances, we may need to inspect the item to determine the cause of the problem before we issue a replacement or store credit. A replacement or credit towards your next La Piastra in-store purchase will be provided at that time.

Gift Cards.  Gift Cards are available in any denomination up to $300.00 for purchase and redemption in-store or online. Gift Cards cannot be redeemed for cash unless otherwise required by law. If your Card is lost, stolen, or used improperly, please contact us immediately.

Disclaimers.  WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE WARRANTY OF TITLE, MERCHANTABILITY, NON-INFRINGEMENT OF THIRD PARTIES’ RIGHTS, AND FITNESS FOR PARTICULAR PURPOSE AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE.

IN CONNECTION WITH ANY WARRANTY, CONTRACT, OR COMMON LAW TORT CLAIMS: (I) WE SHALL NOT BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION RESULTING FROM THE USE OR INABILITY TO ACCESS AND USE THE SERVICES OR THE CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (II) ANY DIRECT DAMAGES THAT YOU MAY SUFFER AS A RESULT OF YOUR USE OF THE SERVICES SHALL BE LIMITED TO THE MONIES YOU HAVE PAID US IN CONNECTION WITH YOUR USE OF THE SERVICES DURING THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENTS GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES. THEREFORE, SOME OF THE ABOVE LIMITATIONS ON WARRANTIES IN THIS SECTION MAY NOT APPLY TO YOU.

THE SERVICES MAY CONTAIN TECHNICAL INACCURACIES, TYPOGRAPHICAL ERRORS, OR OMISSIONS, INCLUDING WITH RESPECT TO ALLERGY INFORMATION AND/OR FOOD PREPARATION STANDARDS.  WE ARE NOT RESPONSIBLE FOR ANY SUCH TYPOGRAPHICAL, TECHNICAL, PRICING, OR OTHER ERRORS LISTED ON OR OMITTED FROM THE SERVICES.  A REFERENCE TO A PRODUCT ON THE SERVICES DOES NOT GUARANTY OR IMPLY THAT SUCH PRODUCT IS OR WILL BE AVAILABLE FOR PURCHASE.  WE RESERVE THE RIGHT TO MAKE CHANGES, CORRECTIONS, AND/OR IMPROVEMENTS TO THE SERVICES AT ANY TIME WITHOUT NOTICE.

WE RESERVE THE RIGHT TO CANCEL OR MODIFY AN ORDER WHERE IT APPEARS THAT A CUSTOMER HAS ENGAGED IN FRAUDULENT OR INAPPROPRIATE ACTIVITY OR UNDER OTHER CIRCUMSTANCES WHERE IT APPEARS THAT THE ORDER CONTAINS OR RESULTED FROM A MISTAKE OR ERROR.

Compliance with Applicable Laws. You agree that: (i) the La Piastra website shall be deemed solely based in Connecticut; and (ii) the websites shall be deemed passive websites and applications that do not give rise to personal jurisdiction over La Piastra, either specific or general, in jurisdictions other than Connecticut. We make no claims concerning whether the Content may be downloaded, viewed, or be appropriate for use outside of the United States. If you access the Services or our digital content from outside of the United States, you do so at your own risk. Whether inside or outside of the United States, you are solely responsible for ensuring compliance with the laws of your specific jurisdiction.  You expressly acknowledge and agree that this Agreement is formed in and governed by the laws of the State of Connecticut.
